Europos Sąjunga irgi turi tarybą, kuri sutrumpintai vadinama Europos Taryba, bet tai - ne ta Europos Taryba, kuri stovi Strasbūre greta Europos Parlamento ir kuriai priklauso Strasbūro teismas.

Europos žmogaus teisių teismo sprendimai privalomi valstybei, kurios atžvilgiu priimtas sprendimas.

Tuo tarpu ES nėra net prisijungusi prie Žmogaus teisių konvencijos.

Kokie tie sprendimai?

Европейский суд по правам человека не является высшей инстанцией по отношению к судебной системе государства-участника конвенции.

Поэтому он не может отменить решение, вынесенное органом государственной власти или национальным судом, не даёт указаний законодателю, не осуществляет абстрактный контроль национального законодательства или судебной практики, не имеет права давать распоряжения о принятии мер, имеющих юридические последствия.

Суд рассматривает только конкретные жалобы с тем, чтобы установить, действительно ли были допущены нарушения требований конвенции.

Однако Суд вправе присудить «справедливое удовлетворение претензии» в виде финансовой компенсации материального ущерба и морального вреда, а также возмещение выигравшей стороне всех издержек и расходов.

За всю многолетнюю практику Европейского суда не было зафиксировано ни одного случая неисполнения решений Суда государствами-членами Совета Европы.

Land grabbing

It's not necessarily a problem when wealthy companies invest in agricultural land in poor countries for commercial use. But when families are kicked off the land or less food is grown as a result, that's a very big problem indeed. Recent data indicates that at least 33 million hectares of land deals have been identified since 2001 – an area 8 times the size of the Netherlands.

And since the food price spikes of 2008, that's been happening more and more.

Land grabbing.

Research managed by the Overseas Development Institute in January 2013 found that the size of the ‘global land grab’ may have been exaggerated, with limited data available, and the data that existing associated with NGOs with an interest in generating media attention around the issue. They found that the figures below provide a variety of estimates, all in the tens of millions of hectares.

• The International Food Policy Research Institute (IFPRI) estimated in 2009 that between 15 and 20 million hectares of farmland in developing countries had changed hands since 2006.

• The Land Portal’s Land Matrix data as accessed in January 2013 now totals 49 million hectares of deals globally, although only 26 million hectares of these are transnational.

• A World Bank report reported 57 million hectares worldwide,

• Friis & Reenberg (2012) reported between 51 and 63 million hectares in Africa alone.

The GRAIN database published in January 2012, quantified 35 million hectares, although when stripping out more developed economies such as Australia, New Zealand, Poland, Russia, Ukraine and Romania, the amount in the GRAIN database reduces to 25 million hectares.

The recent growth of “land grabs” is leading to disastrous consequences for poor communities.
